By purchasing a OTS+ or Custom Tune package from "Vigor Tuning, LLC," you, referred to as the "Customer," hereby confirm your understanding of the inherent risks associated with testing and tuning your vehicle (including Dynamometer and/or OFF-ROAD TRACK USE). Furthermore, you assert that you possess the full authority to authorize the tuning of your vehicle and to enter into this Release agreement.
You acknowledge that some or all of the parts and/or tuning may not comply with Federal, State, Province, and/or Local laws, ordinances, and regulations. As the "Customer," you assume the responsibility to ensure that any modifications or upgrades made to your vehicle comply with all applicable laws and regulations for road use, particularly regarding safety and emissions. You acknowledge that Vigor Tuning, LLC has informed you that certain parts are intended exclusively for Racing Competition and are not suitable for road car usage. You absolve Vigor Tuning, LLC of any burden of responsibility for ensuring your vehicle's compliance with regulations set forth by Federal, State, and/or Local governing agencies. This waiver of compliance remains in effect for all past, current, and future purchases from Vigor Tuning, LLC.
Vigor Tuning, LLC categorically declares that we will not alter emissions-related settings in any manner. We will not suppress the Check Engine Light (CEL) if the vehicle is missing any emissions-related devices. Under no circumstances do we modify the calibration file to delete or disable emissions devices, nor do we enforce system readiness if the vehicle lacks any emissions-related devices or hardware. The emissions tuning and readiness checks remain unaltered and are 100% in accordance with the original equipment manufacturer (OEM) specifications. It is crucial to emphasize that this file is exclusively intended for OFF-ROAD, LEGAL RACING, COMPETITION, or areas where it is legal for you to do so. You assure Vigor Tuning, LLC that you as the owner will be following the laws in your local jurisdiction.
As the "Customer," you acknowledge and accept the risk of running your vehicle on a dynamometer or OFF-ROAD TRACK/COURSE for tuning purposes. You assure "Vigor Tuning, LLC" that this vehicle will not be driven on public roads unless it is legal for you to do so in your area. You further guarantee that it will never be used in any illegal manner. You, as the "Customer," assume all liability for yourself and your vehicle. This product/service may not be legal in your state or country.
As the "Customer," you hereby represent that you are aware of the condition of the vehicle and assure that it is in an acceptable state to undergo testing/tuning on the Dynamometer or OFF-ROAD TRACK/COURSE. You are hereby informed that "Vigor Tuning, LLC" does not possess knowledge of the condition of the vehicle being tested/tuned, and despite this, you agree to proceed with the testing/tuning on the Dynamometer or OFF-ROAD TRACK/COURSE. You represent that all parts of the vehicle are in good condition and capable of operating at full power during the testing/tuning process.
Consequently, you release "Vigor Tuning, LLC" from any and all liability for damages or other losses that may arise as a result of the testing/tuning on a Dynamometer or OFF-ROAD TRACK/COURSE, whether for testing, tuning, or any other reason. Furthermore, you acknowledge that "Vigor Tuning, LLC" does not offer any form of warranty, whether written or oral, in any manner.
You reaffirm to "Vigor Tuning, LLC" that the vehicle being tuned or modified is exclusively designated for OFF-ROAD/LEGAL RACING purposes and will not be operated on public roads if it is not legal for you to do so in your area. You assure Vigor Tuning, LLC that you have not removed or attempted to disable any emissions equipment from a road-going vehicle, and your vehicle is solely intended for competition use or permitted areas specific to your locale.
Vigor Tuning, LLC reserves the right to terminate any agreements without notice. All purchases are final, non-refundable, and non-transferable. Failure to adhere to any part of the agreed-upon Terms and Conditions/Vehicle Compliance Waiver/Disclaimer/Release may result in immediate termination of the tuning process, and no refunds will be issued. This includes violations of local/state/provincial laws related to on-road use/emissions.
Vigor Tuning, LLC has a ZERO ABUSE policy. Any use of abusive language or engaging in bullying behavior will result in instant termination of services, and no refunds will be provided. We do not tolerate abusive behavior/language in any form. Please maintain a polite and professional demeanor.
